YOU MAY ONLY APPLY FOR, OPEN, AND MAINTAIN AN ACCOUNT WITH INFLUSFERA (“ACCOUNT”) AND/OR OTHERWISE ACCESS OR USE THE SERVICES IF YOU AGREE TO THIS TERMS OF SERVICE. This Terms of Service (this “Agreement”) explains the terms under which you may access and use the technology platform and services we make available to you (the “Services”) that we, Influsfera, Inc. (“Influsfera,” “we,” “our,” “us”), provide through https://www.influsfera.com (the “Website”). As used in this Terms of Service, “you” refers to the individual or entity using the Services. If you do not agree to these Terms of Service in their entirety, you are not authorized to use the Platform in any manner or form whatsoever.
THIS TERMS OF SERVICE CONTAINS DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITIES (SEE SECTIONS 10 AND 11). THIS AGREEMENT ALSO CONTAINS ARBITRATION PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. SUCH ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW IN SECTION 11 OR IF YOU OPT-OUT.
We may modify this Terms of Service by posting an amended version at https://www.influsfera.com/terms. The amended version will be effective at the time we post it unless otherwise noted. If an amended version changes a material term, we will provide you with reasonable prior notice before the changes become binding on you. If you do not accept any such amendment, you must stop using the Services. Your continued use of the Services after any modification constitutes acceptance of the revised Terms of Service.
1. Your Representations
By using the Platform and agreeing to this Terms of Service, you represent that you are at least the age of majority in your jurisdiction. If you create an account, you affirm that you have the legal capacity to enter into a binding contract, have read this Agreement, and understand and agree to its terms.

We reserve the right to suspend or terminate accounts that violate our policies or engage in fraudulent, illegal, or harmful activities.
4. Account Restrictions
Influsfera may suspend or terminate accounts engaged in the following Prohibited Activities:
Using the Platform for fraudulent, deceptive, or unlawful activities.
Disrupting the Website or attempting unauthorized access.
Collecting data from the Website without permission.
Impersonating others or misrepresenting affiliations.
Engaging in spam, harassment, or abuse.
We may take legal action against users involved in Prohibited Activities.
5. Privacy & Security Disclosure
By using the Services, you acknowledge and agree to our Privacy Policy, available at https://www.influsfera.com/privacy-policy.
We do not share personal information with third parties for their marketing without consent. However, we may collect and analyze anonymized data to improve our services.
6. Intellectual Property Rights
All content on the Platform, including text, graphics, logos, software, and trademarks, is owned by Influsfera or its licensors. You may not copy, distribute, modify, or use any content without our written permission.
If you submit feedback or suggestions, you grant Influsfera the right to use them without compensation.
7. Modifications to the Platform or Services
We reserve the right to modify or discontinue any part of the Platform without notice. We are not liable for any modifications, suspensions, or terminations.
8. Third-Party Websites and Links
Our Platform may contain links to third-party websites. We are not responsible for their content, policies, or practices. Use third-party sites at your own risk.
9. Disclaimer of Warranties
THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE PLATFORM.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFLUSFERA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
11. Mandatory Binding Arbitration and Class Action Waiver
All disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).
By agreeing to this Terms of Service, you waive your right to participate in a class action lawsuit or class-wide arbitration.
12. Indemnification
You agree to indemnify, defend, and hold Influsfera and its affiliates harmless from any claims, losses, damages, or expenses arising from:
Your violation of these Terms of Service.
Your misuse of the Platform.
Your infringement of any third-party rights.
